This matter came before the Court on “Defendant’s Motion to Apply Civil Rules of Procedure.” The Court has considered the allegations of the motion, the status of the litigation, arguments of counsel, and case law submitted by counsel.

In view of the above, it is:

ORDERED the “Defendant’s Motion to Apply Civil Rules of Procedure” is hereby GRANTED in part, and DENIED in part. The Rules of Civil Procedure will apply to this cause, except for Rule of Civil Procedure 1.442, relating to Proposals of Settlement, which has no counter-part in the Summary Rules of Procedure.
