AMENDED ORDER ON PLAINTIFF’S MOTION FOR FINAL SUMMARY JUDGMENT AND DEFENDANT’S MOTION FOR FINAL SUMMARY JUDGMENT

THIS CAUSE having come before the Court on the Plaintiff’s Motion for Final Summary Judgment and the Defendant’s Motion for Final Summary Judgment, and the Court having heard arguments of counsel and being otherwise fully informed in the premises, it is thereupon,

ORDERED AND ADJUDGED as follows:

1. The Plaintiff’s Motion for Final Summary Judgment is DENIED.

2. The Defendant’s Motion for Final Summary Judgment is GRANTED. The court finds that the policy at issue expired prior to the date of loss, thus there was no coverage. Accordingly, an insurer is under no obligation to provide the Provider with a declarations page, copy of the policy or PIP log pursuant to either Sections 627.4137 or 627.736, Florida Statutes.
