FINAL JUDGMENT

Pursuant to this Honorable Court’s granting of Plaintiff’s Motion for Summary Judgment on September 7, 2007, and the stipulation of the parties on June 5, 2007:

IT IS ORDERED AND ADJUDGED:

1- The underlying claim in this action was resolved by the granting of Plaintiff’s Motion for Final Summary Judgment on September 7, 2007. The Defendant will pay Plaintiff the amount of eight hundred sixty one dollars and twelve cents ($861.12) in benefits plus thirty eight dollars and seventy five cents ($38.75) in interest for a total of eight hundred and ninety nine dollars and eighty seven cents ($899.87).

This amount will bear interest at the rate of 10% pre annum until paid.

2- Furthermore, the parties stipulate that the Plaintiff is entitled to the following award of attorney’s fees and costs as follows:

The hourly rate for David Lipscomb, Esquire is $250.00 per hour. The hourly rate for Timothy Patrick, Esquire and Helen Stratigakos, Esquire is $325.00 per hour. Fifty Eight point 9 (58.9) hours at $325.00 per hour which equals $19,142.50 and Two point three (2.3) hours at $250.00 which equals $575.00 for a total lodestar amount of $19,142.50. A multiplier of 1.5 is applicable for a total fee award of $29, 576.25, costs in the amount of $423.75. The total amount due and owing for attorney’s fees and costs is $30,000.00.

All issues are resolved and the parties stipulate that this matter shall be dismissed with prejudice upon execution of this order.
